Terms and Conditions of Engagement of Legal Adviser for Mizoram Khadi & Village Industries Board.
1. The Legal Adviser is the adviser of the Board on legal matters and holds Office during the pleasure of the Board. His engagement is for a period of two years with effect from the date of engagement to be terminated at the end of two years unless otherwise re-engaged by the Board.
2. The Legal Adviser shall advise the Board on Legal matters.
3. The Legal Adviser shall represent the Board in all Court Cases at various levels by drafting petitions, affidavits, filing them in the court and Conducting the cases till final disposal.
4. The Legal Adviser is debarred from Contesting, appearing, advising and holding briefs in all Cases against the Board and he is further debarred from representing private parties in Cases where the Board is Impleaded as one of the respondents.
5. The Legal Adviser shall be paid a monthly retainer fee Rs. 10,000/- (Rupees Ten Thousand) only per month. In additional to the retainer fee, the Legal Adviser shall be paid Rs. 10,000/- ( Rupees Ten Thousand only) per hearing while conducting cases in the Hon’ble Gauhati High Court, Aizawl Bench.
6. The Legal Adviser shall be entitled to have a cut of 2% commission on amount collected by him by way of Legal procedures which involved seizure and auction mortgaged properties and other personnel properties and collection effected by him from loanees/guarantors.
7. The Legal Adviser shall be entitled to Travelling Allowances and Daily Allowances when travelling or halting at Stations outside the Headquarters (Aizawl) on official duty of the Board at the rate admissible to the Senior Grade level of the Board’s Service.
8. The Legal Adviser shall perform Legal and official duties as are referred to him from time to time.
9. In case of resignation/termination from the engagement as Legal Adviser, it shall be mandatory for both the Legal Adviser and the Board to give 1 (one) month’s notice before resignation/termination.
